23101939DBe it enacted by the General Assembly of Virginia:
1. That the Code of Virginia is amended by adding a section numbered 30-12.1 as follows:
§ 30-12.1. Annual verification of residence within district.
Each member of the General Assembly shall submit to the clerk of his respective house, on a form prescribed by the Joint Rules Committee for such purpose, a certification of his legal residence, including the house number, street name or rural route address, city, and zip code, signed by him under penalty of perjury to be true and correct. Such legal residence certification shall be submitted annually to the appropriate clerk no later than the Friday following the date of the November general election, but not earlier than November 1.
Upon receipt of a member's legal residence certification, the clerk of such member's house shall verify that the address provided on the certification is within the district for which the member was most recently elected. In accordance with Article IV, Section 4 of the Constitution of Virginia, a member who is found to not be a resident of the district for which he was most recently elected shall thereby vacate the office. Such vacancy shall be filled in the manner provided in § 24.2-216.
