Notwithstanding Section 19.2-163, Code of Virginia, out of the amounts appropriated in the item, $10,993,273 the second year from the general fund is provided to support increasing the maximum compensation payment for court-appointed counsel for indigent parents in child dependency cases to $445 for child removal proceedings through foster care or permanency planning stages and $1,235 for termination of parental rights proceedings."

        Explanation:

        (This amendment provides $11.0 million GF the second year to increase the maximum compensation allowed for court-appointed counsel for indigent parents involved in child dependency cases, from $120 to $445 per case for child removal proceedings (through foster care or permanency planning stages) and from $120 to $1,235 per case for termination of parental rights proceedings. An additional appropriation of $3,158,342 NGF from federal Title IV-E funding, administered by the Department of Social Services, is needed to fully fund the change. This was a recommendation of the Child Dependency Legal Representation Workgroup led by the Office of the Children's Ombudsman.)

        "E. Notwithstanding any other provision of law, (i) the State Air Pollution Control Board shall not adopt or enforce any model year standards related to control of emissions from new motor vehicles or new motor vehicle engines, including low-emission vehicle and zero-emission vehicle standards, pursuant to § 177 of the Federal Clean Air Act (42 U.S.C. § 7507) and (ii) the Commonwealth shall not require any new motor vehicle or new motor vehicle engine to be certified as compliant with model year standards related to the control of emissions adopted by California for which a waiver has been granted pursuant to § 209 of the federal Clean Air Act (42 U.S.C. § 7543)."

        Explanation:

        (This amendment prohibits the State Air Pollution Control Board from adopting model year standards for new vehicle emissions or requiring a new vehicle to be certified as compliant with California emission control standards.)
