SENATE BILL NO. 706 AMENDMENT IN THE NATURE OF A SUBSTITUTE (Proposed by the Senate Committee on Transportation on February 10, 2022) (Patron Prior to Substitute--Senator Marsden) A BILL to amend the Code of Virginia by adding a section numbered 46.2-803.2, relating to trucks; operation in certain weather conditions.

Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding a section numbered 46.2-803.2 as follows:

§ 46.2-803.2. Operation of heavy trucks in certain weather conditions.

A. When driving a truck or truck and trailer or semitrailer combination with a gross weight rating greater than 26,000 pounds during active snow, sleet, or freezing rain, the operator:

1. Shall, if reasonably possible and conditions safely permit, drive the vehicle in the right-most lane of any highway having two or more lanes in each direction;

2. Shall not utilize cruise control; and

3. Shall not utilize compression release engine brakes.

B. This section shall not apply to the operation of pickup trucks or panel trucks.

C. No law-enforcement officer shall stop a motor vehicle for a violation of subdivision A 2 or 3. No evidence discovered or obtained as the result of a stop in violation of this subsection, including evidence discovered or obtained with the operator's consent, shall be admissible in any trial, hearing, or other proceeding.
