Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding a section numbered 36-99.5:2 as follows:

§ 36-99.5:2. Smoke detectors required in new residential dwellings.

Battery operated or AC powered smoke alarm devices shall be installed in all new residential dwellings. All battery operated smoke alarm devices shall be equipped with a battery capable of lasting at least 10 years. The location and installation of the smoke alarms shall be determined by the Building Code. The owner of such residential dwelling shall be responsible for the maintenance of the smoke alarm device.
