Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding a section numbered 22.1-28.1 as follows:

§ 22.1-28.1. School boards; production of public records; fee schedules.

Each school board shall develop and post or otherwise make publicly available a fee schedule governing charges for the release of public records pursuant to the Virginia Freedom of Information Act (§ 2.2-3700 et seq.). Such fee schedules shall be based on the most recent estimate of the aggregate costs incurred by each school within a school board's division in accessing, duplicating, supplying, or searching for requested public records, in accordance with § 2.2-3704. Every school within a division shall use the fee schedule developed by its school board when responding to requests for public records pursuant to § 2.2-3704. School boards shall review and update the fee schedules required by this section at least annually.
