22102624DBe it enacted by the General Assembly of Virginia:
1. That the Code of Virginia is amended by adding a section numbered 2.2-4303.02 as follows:
§ 2.2-4303.02. Moderate-risk contracts; definition; review.
Prior to awarding a moderate-risk contract, a state public body shall conduct a review of potential savings available through programs administered by the federal General Services Administration. Such review shall be formalized in a written report, which shall be submitted to the Department of General Services. The public body shall make a reasonable effort to apply for any cost-savings program found either by the public body or brought to the attention of the public body by the Department of General Services.
Upon receipt of the report, the Department of General Services shall make a written determination of whether the review conducted by the public body accurately assessed any available programs or failed to identify programs appropriate to the contract. If the Department of General Services finds that the agency failed to identify an available program that may reasonably lead to savings for the agency or the Commonwealth, the Department shall so notify the agency of the program within 30 days of receipt of the initial review.
For the purposes of this section, "moderate-risk contract" means any public contract with a state public body that is anticipated to cost in excess of $250,000.
