AMENDMENT IN THE NATURE OF A SUBSTITUTE

A BILL to provide for a special election for members to the Loudoun County School Board and to set a timeframe for a lot drawing to determine the staggering of terms of members to the Loudoun County School Board.

Be it enacted by the General Assembly of Virginia:

1. § 1. Notwithstanding any provision of law to the contrary, the provisions of this act shall apply to the election of members to the Loudoun County School Board.

§ 2. Any member of the Loudoun County School Board currently serving a term that is to expire on December 31, 2023, shall have his term of office shortened by one year but shall continue in office until his successor has been elected at the special election held pursuant to § 3 and has been qualified to serve.

§ 3. There shall be a special election conducted in Loudoun County on November 8, 2022, to elect members to the Loudoun County School Board from each of the nine districts. The members elected at this election shall serve for the unexpired terms set to expire on December 31, 2023.

§ 4. The Loudoun County Electoral Board shall, at its first meeting of 2023 but no later than January 31, 2023, conduct a lot drawing to determine the staggering of terms for members of the Loudoun County School Board (the school board) in accordance with the provisions of § 22.1-57.3:1.1 of the Code of Virginia. At the regularly scheduled November 7, 2023, general election, members of four of the nine districts, inclusive of the at-large district, will be elected to the school board for terms of four years and members of the remaining five districts will be elected to the school board for terms of two years. Thereafter, all members shall be elected for four-year terms and the school board elections shall be conducted biennially for staggered terms.

§ 5. The Department of Elections shall develop instructions to implement the provisions of this act.

2. That the State Board of Elections shall set a schedule for the filing of all forms and documentation required by Chapter 5 (§ 24.2-500 et seq.) of Title 24.2 of the Code of Virginia and a schedule for the filing of all campaign finance reports required by the Campaign Finance Disclosure Act of 2006 (§ 24.2-945 et seq. of the Code of Virginia).
