Be it enacted by the General Assembly of Virginia:
1. That the Code of Virginia is amended by adding a section numbered 30-394.1 as follows:
§ 30-394.1. Removal of citizen commissioners for neglect of duty or gross misconduct.
The commissioners comprising the Commission may in an open meeting vote to remove a citizen commissioner on grounds of neglect of duty or gross misconduct with respect to the duties required to be performed by, or responsibilities of, citizen commissioners under this chapter. The vote taken shall be by roll call or other recorded vote.
The Commission may establish policies relating to the vote total required to remove a citizen commissioner. In no event shall any such policy establish a required vote of less than a majority of the commissioners comprising the commission to remove a citizen commissioner.
If the commissioners vote in the affirmative to remove a citizen commissioner, the vacancy created shall be filled for the unexpired term in the same manner as provided in subsection C of § 30-392 for filling vacancies.
“Open meeting” means the same as that term is defined under § 2.2-3701 of the Code of Virginia.
2. That an emergency exists and this act is in force from its passage.
