Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding a section numbered 18.2-152.7:2 as follows:

§ 18.2-152.7:2. Using computer to commit hoax; penalty.

Any person who maliciously uses a computer that is Internet capable as part of a hoax that causes another person or business to expend monetary funds that would not have been expended if not for the hoax, when the person using such computer knew or should have known the monetary funds would be expended, is guilty of a Class 1 misdemeanor. It is not a defense to a violation of this section that the defendant did not receive any direct or indirect benefit from the defendant's malicious act.
