Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding a section numbered 54.1-1108.01 as follows:

§ 54.1-1108.01. Responsible management personnel; alternate designated employee.

A. Any member of a contractor's responsible management who is at least 18 years of age may serve as an alternate designated employee, provided that he successfully completes the examination required pursuant to § 54.1-1106 or 54.1-1108, as appropriate. The Board shall maintain for each contractor a list of individuals who are qualified alternate designated employees.

B. A contractor may submit any qualified alternate designated employee to serve as the designated employee of record with the Board to replace a designated employee who is no longer a full-time employee of the contractor.
