19103897DBe it enacted by the General Assembly of Virginia:
1. § 1. That the Board of Social Services shall amend regulations governing staffing of units of assisted living facilities with residents who have serious cognitive impairment due to a primary psychiatric diagnosis of dementia or any other diagnosis and are unable to recognize danger or protect their own safety and welfare to create an exception to the requirement that when 20 or fewer residents are present, at least two direct care staff members shall be awake and on duty and responsible for the care and supervision of the residents at all times during overnight hours and provide that during overnight hours, at least one direct care staff member shall be awake and on duty and responsible for the care and supervision of residents when 10 or fewer residents are present.
