Be it enacted by the General Assembly of Virginia:

1. That § 33.2-280.1 of the Code of Virginia is amended and reenacted as follows:

§ 33.2-280.1. Charging electronic toll collection device fees.

The Department shall not, as:

1. As a result of inactivity on the part of the holder of any electronic toll collection device for a time period of less than one year, (i) charge maintenance fees for electronic toll collection devices or (ii) require users to exchange their electronic toll collection device for a different type.

2. Charge any monthly fee in connection with online monthly statements for any electronic toll collection device.
