Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding in Chapter 7 of Title 54.1 a section numbered 54.1-707 as follows:

§ 54.1-707. License by endorsement; issuance of licenses to spouses of military service members.

A. The Board shall issue a license to practice as a barber, cosmetologist, nail technician, or wax technician to any applicant who holds a similar license or certification issued by another state, provided that (i) the license or certificate is valid, (ii) the applicant is in good standing with the regulatory entity that issued the license or certification, and (iii) either (a) the training and examination requirements for such license or certificate are comparable to the training and examination requirements prescribed by the Board or (b) the applicant possesses at least five years of experience working in a licensed barbershop, cosmetology salon, nail salon, or waxing salon, as applicable. Such applicant shall not be required to complete any additional training or examination requirements to be issued a license by the Board.

B. Notwithstanding the provisions of § 54.1-119, the Board shall issue a license to practice as a barber, cosmetologist, nail technician, or wax technician to any applicant (i) whose spouse is the subject of a military transfer to the Commonwealth, (ii) who accompanies the applicant's spouse to Virginia, and (iii) who holds a similar license or certification issued by another state, provided that the license or certificate is valid and the applicant is in good standing with the regulatory entity that issued the license or certification. Such applicant shall not be required to complete any additional training or examination requirements to be issued a license by the Board.

C. The provisions of this section shall apply regardless of whether a regulatory board has entered into a reciprocal agreement with the other jurisdiction pursuant to subsection B of § 54.1-103.

D. The Board may require the applicant to provide documentation it deems necessary to make a determination of comparability.
