Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding a section numbered 36-99.02 as follows:

§ 36-99.02. Building Code provisions for commercial buildings and structures in rural areas.

A. The Board is hereby directed and empowered to make amendments to the Building Code applicable to commercial buildings and structures located in rural areas. Such amendments shall ensure protection of the public health, safety, and welfare and establish standards that (i) are particularly suited for the unique character of the state's rural areas, (ii) are capable of consistent enforcement throughout the state's rural areas, and (iii) include consideration for the mixed use of a building or structure for retail and manufacturing purposes.

B. Any building or structure for which (i) a building permit has been issued or on which construction has commenced or (ii) working drawings have been prepared in the year prior to the effective date of the amendments to the Building Code promulgated by the Board pursuant to this section shall remain subject to the Building Code in effect at the time of such issuance or commencement of construction. Subsequent reconstruction, renovation, repair, or demolition of such buildings or structures shall be subject to the amendments to the Building Code promulgated by the Board pursuant to this section.

C. The Board shall establish guidelines for the adequate training of building officials, enforcement personnel, contractors, and design professionals regarding Building Code provisions applicable to commercial enterprises located in buildings and structures in rural areas.
