Be it enacted by the General Assembly of Virginia:

1. § 1. That the State Water Control Board (Board), in its renewal of the Virginia Pollutant Discharge Elimination System permit for the Combined Sewer Overflow (CSO) system of the City of Richmond (the City) next following January 1, 2018, shall require the City to complete by January 1, 2020, an assessment of the discharges from each of its Combined Sewer Outfalls into the James River. The assessment shall incorporate all sewer system improvements, whether completed or ongoing at the time of the assessment, that are designed to address discharges from any part of the CSO system of the City. The assessment also shall evaluate strategies and engineering analyses to determine the level, type, and cost of, and schedule for, any control technologies or other measures that may be required to meet applicable regulations.

§ 2. Copies of the completed assessment shall be delivered to the Board, the Chairman of the Senate Agriculture, Conservation and Natural Resources Committee, and the Chairman of the House Agriculture, Chesapeake and Natural Resources Committee.

§ 3. To the extent necessary to carry out the provisions of this act, the Board shall, with the consent of the City, modify or amend an existing consent order or issue a new consent order. No provision of this act shall be construed as altering, modifying, or amending any term or condition contained in any existing permit.

2. That an emergency exists and this act is in force from its passage.
