Be it enacted by the General Assembly of Virginia:

1. That § 62.1-239.1 of the Code of Virginia is amended and reenacted as follows:

§ 62.1-239.1. Loans, loan subsidies, and grants for regional projects, etc.

In approving loans and grants, the Board shall give preference to loans, loan subsidies, and grants for projects that will (i) utilize private industry in operation and maintenance of such projects where a material savings in cost can be shown over public operation and maintenance or, (ii) serve two or more local governments or other entities to encourage regional cooperation, or (iii) accomplish both goals. When evaluating projects located in the Eastern Virginia Groundwater Management Area, created pursuant to the Ground Water Management Act of 1992 (§ 62.1-254 et seq.), the Board shall give additional priority to projects related to the development of water sources to serve as alternatives to the withdrawal of groundwater from the coastal plain aquifer.
