17102417DBe it enacted by the General Assembly of Virginia:
1. That the Code of Virginia is amended by adding a section numbered 33.2-272.1 as follows:
§ 33.2-272.1. Intrastate or interstate pipelines; Department of Transportation oversight.
Whenever the Department issues a permit for work on highways related to the construction of an intrastate or interstate pipeline, the Department shall (i) document by video the existing condition of the highways on the approved route of such pipeline prior to construction; (ii) require a geotechnical report that includes (a) site-specific physical, environmental, and geological data, (b) discussion of major assumptions or data used in the geotechnical analyses, and (c) design and construction recommendations; and (iii) prepare an inspection report detailing the condition of the highways and the content of the geotechnical report and make such inspection report available to the public on its website.
The Department shall enter into an agreement with the entity constructing such pipeline defining the responsibilities for any required improvements to affected highways before, during, and after completion of the project.
