17105190DBe it enacted by the General Assembly of Virginia:
1. That the Code of Virginia is amended by adding a section numbered 18.2-121.3 as follows:
§ 18.2-121.3. Trespass with an electronic device; penalty.
A. Any person who, after being given notice to desist, knowingly and intentionally causes any electronic device to enter the property of another with the intent to coerce, intimidate, or harass any other person is guilty of a Class 3 misdemeanor. A second or subsequent conviction of a violation of this section is punishable as a Class 2 misdemeanor if such person was convicted of the prior offense before the date of the instant offense.
B. This section shall not apply to any person who uses an electronic device to enter such property if the entry is reasonably related to any lawful business purpose or activity, regardless of whether such business purpose or activity is conducted for profit.
