SUMMARY AS PASSED HOUSE:

Insurance notices; electronic delivery. Repeals a clause that would have sunset on December 31, 2016, that (i) makes the notification to an insurer of any change of the electronic address for the named insured the sole responsibility of the named insured and (ii) states that giving notice of change of the named insured's electronic address to the agent of record shall not be deemed to be notice to the insurer unless it is specifically identified as a change and receipt has been accepted by the agent of record.

SUMMARY AS INTRODUCED:

Insurance notices; electronic delivery. Provides that an insurance agent shall not be subject to civil liability for any harm or injury that occurs as a result of a party's election to receive any notice or document by electronic means or by an insurer's failure to deliver a notice or document by electronic means. This provision replaces a measure, which is scheduled to sunset December 31, 2016, that (i) makes the notification to an insurer of any change of the electronic address for the named insured the sole responsibility of the named insured and (ii) states that giving notice of change of the named insured's electronic address to the agent of record shall not be deemed to be notice to the insurer unless it is specifically identified as a change and receipt has been accepted by the agent of record.
