16100173DBe it enacted by the General Assembly of Virginia:
1. That the Code of Virginia is amended by adding in Chapter 1 of Title 22.1 a section numbered 22.1-7.2 as follows:
§ 22.1-7.2. Redistricting of school boundaries; assignment of students.
A. Notwithstanding § 22.1-7.1 or subdivision 4 of § 22.1-79, each school division that provides for the redistricting of school boundaries shall permit:
1. Any enrolled elementary school student who is assigned to a different elementary school in the school division as a result of such redistricting to remain, at the request of his parent, at the elementary school at which he is currently enrolled until he completes the highest grade level at such school;
2. Any enrolled middle school student who is assigned to a different middle school in the school division as a result of such redistricting to remain, at the request of his parent, at the middle school at which he is currently enrolled until he completes the highest grade level at such school; and
3. Any enrolled high school student who is assigned to a different high school as a result of such redistricting to remain, at the request of his parent, at the high school at which he is currently enrolled until he completes the highest grade level at such school.
Each school division may require any parent who makes a request pursuant to this subsection to provide for the transportation of his child, at the parent's own expense, to the school at which the student remains.
B. Nothing in this section shall be construed to require any school division to assign:
1. Any enrolled elementary school student to a middle school to which he would have been assigned before the redistricting of boundaries for such middle school resulted in the assignment of such student to a different middle school in the school division;
2. Any enrolled elementary school student to a high school to which he would have been assigned before the redistricting of boundaries for such high school resulted in the assignment of such student to a different high school in the school division; or
3. Any enrolled middle school student to a high school to which he would have been assigned before the redistricting of boundaries for such high school resulted in the assignment of such student to a different high school in the school division.
