16104408DBe it enacted by the General Assembly of Virginia:
1. That the Code of Virginia is amended by adding a section numbered 9.1-401.2 as follows:
§ 9.1-401.2. Temporarily disabled person; expiration of state certification prohibited.
The state certification of any person who, as a direct or proximate result of the performance of his duty in any position listed in the definition of deceased person in § 9.1-400, has become temporarily mentally or physically disabled so as to prevent the performance of his duty for no longer than 24 months and who is required to have such state certification for the purposes of employment shall not expire during such period of temporary disability.
The Department of Criminal Justice Services shall develop rules and regulations allowing such person up to 12 months after he has returned to work to complete any recertification requirements.
2. That the provisions of this act shall become effective on July 1, 2017.
