Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding a section numbered 33.2-1222.1 as follows:

§ 33.2 -1222.1. Department's tree replacement policy.

In any highway construction project undertaken by the Department, the Department shall adhere to any tree replacement policy adopted by the locality in which such project is located. However, nothing in this section shall be construed to require any review by the Department of any tree replacement policy involved with any highway construction project administered solely by a local government or local governmental entity.
