15100669DBe it enacted by the General Assembly of Virginia:
1. That the Code of Virginia is amended by adding in Chapter 7 of Title 19.2 a section numbered 19.2-83.3 as follows:
§ 19.2-83.3. Procedure upon arrest for certain drug offenses; Prescription Monitoring Program.
In any case in which an officer arrests a person for a violation of Article 1 (§ 18.2-247 et seq.) of Chapter 7 of Title 18.2 involving a controlled substance, where the dispensing of such substance is required to be reported to the Prescription Monitoring Program (§ 54.1-2519 et seq.), the arresting officer shall cause to be requested pursuant to § 54.1-2523 information from the Program regarding the identity of the prescriber as defined in § 54.1-2519, if available. However, if the arresting officer already knows the identity of the prescriber, he does not have to request such information from the Program. The arresting officer shall cause the prescriber to be notified of the arrest, unless such notification would jeopardize an ongoing criminal investigation.
