Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding in Article 1 of Chapter 6 of Title 2.2 a section numbered 2.2-614.4 as follows:

§ 2.2-614.4. Commercial activities list; certain government action prohibited.

A. As used in this section, unless the context requires a different meaning:

"Commercial activities list" means the list developed by the Department of Planning and Budget in accordance with § 2.2-1501.1.

"Governmental agency" means any authority, board, department, instrumentality, institution, agency, or other unit of state government and any county, city, or town, or local or regional governmental authority.

B. Contracts for the procurement of goods or services between governmental agencies for goods or services that are on the commercial activities list are prohibited.
