Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding a section numbered 33.2-1202.1 as follows:

§ 33.2-1202.1. Powers of Commissioner of Highways may be transferred to county governing bodies.

The powers granted by this chapter to the Commissioner of Highways shall, upon the passage of a local ordinance to that effect, be transferred to the local governing body of any county that chooses to regulate outdoor advertising within sight of state secondary highway system components within the boundaries of the county. Upon passage of such an ordinance, the powers and responsibilities granted by this chapter shall be exercised by the local governing body or such other local governmental department or entity as the ordinance may provide,
