SUMMARY AS PASSED:

Inventory of physical evidence recovery kits. Requires all local and state law-enforcement agencies to report an inventory of all physical evidence recovery kits in their custody that may contain biological evidence that were collected but not submitted to the Department of Forensic Science for analysis prior to July 1, 2014. The Department shall establish the form of and timeline for such inventory, receive the reports from the law-enforcement agencies, and report the results of the inventory to the General Assembly by July 1, 2015. The bill does not become effective unless an appropriation effectuating the purposes of the bill is included in the general appropriation act passed in 2014 by the General Assembly that becomes law.

SUMMARY AS PASSED SENATE:

Inventory of physical evidence recovery kits. Requires the Department of Forensic Science to create and maintain an inventory of all physical evidence recovery kits that have not been submitted to the Department for analysis prior to July 1, 2014. The bill requires the Department to make arrangements with law-enforcement agencies to submit such physical evidence recovery kits by January 1, 2015. The bill also requires the Department to submit a report of its inventory to the General Assembly prior to the 2015 Session, and to include in its report a plan for analyzing all untested physical evidence recovery kits, and make recommendations regarding categories of physical evidence recovery kits for which testing would be impractical or unproductive. The provisions of the bill are contingent on funding in a 2014 general appropriation act.
