Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding a section numbered 9.1-110.1 as follows:

§ 9.1-110.1. Active Shooter Local Law-Enforcement Training Grant Fund.

A. There is hereby created in the state treasury a special nonreverting fund to be known as the Active Shooter Local Law-Enforcement Training Grant Fund, referred to in this section as "the Fund." The Fund shall be established on the books of the Comptroller. All funds as may be appropriated by the General Assembly and any gifts, grants, or donations from public or private sources shall be paid into the state treasury and credited to the Fund. Interest earned on moneys in the Fund shall remain in the Fund and be credited to it. Any moneys remaining in the Fund, including interest thereon, at the end of each fiscal year shall not revert to the general fund but shall remain in the Fund. Moneys in the Fund shall be used solely for the purposes specified in subsection B. Expenditures and disbursements from the Fund shall be made by the State Treasurer on warrants issued by the Comptroller upon written request signed by the Director of the Department of Criminal Justice Services.

B. The Board shall establish criteria for making grants from the Fund, including procedures for determining the amount of a grant and the required local match, if any. A required local match, if any, shall be based on the composite index of local ability to pay. The Board may adopt guidelines governing the Fund as it deems necessary and appropriate. The Fund is intended to assist localities with smaller populations and fewer resources at their disposal to provide training to their law-enforcement officers in order to prepare for and more effectively respond to active shooter situations. The maximum grant per locality per year is $50,000 and the total amount allocated by the Commonwealth from the Fund shall not exceed $500,000 per year.
