Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding a section numbered 9.1-149.1 as follows:

§ 9.1-149.1. False advertisement for locksmith services; penalty.

A. Upon a determination by the Board that a person who is not registered pursuant to this article to perform locksmith services has placed, circulated, or caused to be placed or circulated before the public through any medium a commercial advertisement that appears in the Commonwealth of any sort offering to perform locksmith services, the Board shall notify the owner or operator of the medium in which the advertisement appeared in writing by certified mail, return receipt requested, mailed to the medium's principal place of business that the person who placed, circulated, or caused to be placed or circulated the advertisement is not authorized to perform locksmith services in the Commonwealth and that the advertisement contains a fraudulent statement of fact. Any medium that knowingly publishes an advertisement for a person who is not registered to perform locksmith services after receipt of such notification from the Board is guilty of a Class 1 misdemeanor.

B. Venue for a prosecution under this section may lie in the jurisdiction where the unlawful act occurs or where the advertisement was accessed by a member of the public.

C. If the Board determines that any person has violated this statute, the Board may impose a civil penalty against such person and may proceed against such person in accordance with the procedures set forth in § 9.1-150.
