Be it enacted by the General Assembly of Virginia:

1.  That the Code of Virginia is amended by adding a section numbered 24.2-701.1 as follows:

§ 24.2-701.1. Solicitation of absentee ballot applications and ballots in hospitals, nursing homes, and assisted living facilities.

It shall be unlawful for any person to solicit, in person, absentee ballot applications or absentee ballots from any individual who is staying in any hospital or nursing home as defined in § 32.1-123 or assisted living facility as defined in § 63.2-100. The prohibition in this section shall not apply to (i) a family member of the person staying in the hospital, nursing home, or assisted living facility; (ii) a general or assistant registrar or the members of the electoral board for a locality; or (iii) the staffs of the general registrar or electoral board. "Family member" means a spouse, parent, grandparent, sibling, child, or grandchild. "Solicit" includes the taking of an absentee ballot application to an individual and requesting the individual to sign the application and the delivery of an absentee ballot to an individual for completion. "Solicit" shall not include the act of assisting an individual in completing the statement of the voter on the envelope for resealing a marked absentee ballot as permitted by § 24.2-706.
