SUMMARY AS PASSED HOUSE:
Virginia Freedom of Information Act; definitions. Clarifies that the definition of a "public record" does not include records that are not prepared for or used in the transaction of public business. The bill is in response to a court case in Loudoun County.
SUMMARY AS INTRODUCED:
Virginia Freedom of Information Act; definition of private record. Defines a "private record" as a record that does not relate to or affect the carrying out of the constitutional, statutory, or other official public business of a public officer, employee, or agent, including the correspondence, diaries, journals, or notes that are not prepared for, utilized for, circulated, or communicated in the course of transacting public business. The bill provides that private records do not constitute public records and states that the physical form or characteristics of the record, including any use of a private or nongovernmental electronic mail account or any other nongovernmental medium, has no bearing on whether or not a record is private as defined by the bill. The bill is in response to a court case in Loudoun County.
