SUMMARY AS PASSED:

Conflict of interests for notaries. Expands what conduct constitutes a conflict of interest for a notary to include the performance of any notarial act with respect to any document, writing, or electronic document where the notary is a signatory or is named in the document to be notarized. A notary who acts in violation of this bill's provision is guilty of official misconduct.

A notary who acts in violation of this bill's provision is guilty of official misconduct.

SUMMARY AS INTRODUCED:

Conflicts of interests for notaries.  Provides that a notary shall not perform any notarial act with respect to any document, writing, or electronic document that presents a conflict between his personal interest and his official duty; a notary who acts in violation of this bill's provision is guilty of official misconduct. Under current law, a notary shall not perform any notarial act with respect to any document, writing, or electronic document to which the notary or his spouse is a party, or in which either of them has a direct beneficial interest, and a notary who performs such act is guilty of official misconduct.
