Be it enacted by the General Assembly of Virginia:

1.  That the Code of Virginia is amended by adding a section numbered 52-8.7 as follows:

§ 52-8.7. Law-Enforcement Pursuit Database.

A. The Department of State Police shall develop and maintain a Law-Enforcement Pursuit Database compiling incident reports of vehicular pursuits occurring statewide. The database shall be made available to the Governor and General Assembly upon request and to any other entity so directed by the Governor or General Assembly. Law-enforcement agencies with law-enforcement duties shall submit vehicular pursuit incident reports for each calendar year to the State Police annually on March 1, beginning March 1, 2013.

B. As used in this section:

“Vehicular pursuit” means an active attempt by a law-enforcement officer in an authorized emergency vehicle to apprehend a fleeing suspect who is actively attempting to elude the law-enforcement officer.

2.  That, on or before January 1, 2012, the Department of State Police shall develop and distribute a vehicular pursuit incident reporting form to each law-enforcement agency in the Commonwealth with law-enforcement duties for use by those agencies to comply with the provisions of this act.
