Be it enacted by the General Assembly of Virginia:

1.  That the Code of Virginia is amended by adding a section numbered 19.2-390.4 as follows:

§ 19.2-390.4. Submission of child pornography to the National Center for Missing and Exploited Children.

A. Any law-enforcement officer who, pursuant to a criminal investigation, recovers digital images or digital videographic recordings of child pornography shall:

1. Provide copies of such images or videographic recordings to the law-enforcement agency representative assigned to the Child Victim Identification Program at the National Center for Missing and Exploited Children (hereinafter “NCMEC”), as required by NCMEC guidelines;

2. Request the law-enforcement agency contact information from the Child Victim Identification Program for any images or videographic recordings recovered that depict an identified victim of child pornography; and

3. Provide case information to the Child Victim Identification Program, as required by NCMEC guidelines, in any case in which the law-enforcement officer identifies a previously unidentified victim of child pornography.

B. Any law-enforcement officer submitting a case for prosecution that involves child pornography shall submit to the designated prosecutor the law-enforcement agency contact information provided by the Child Victim Identification Program at NCMEC for any images or videographic recordings involved in the case that depict an identified victim of child pornography.
