083834436Be it enacted by the General Assembly of Virginia:
1. § 1. The Department of Transportation, in consultation with the Department of Motor Vehicles and representatives of the industries that own and/or operate overload and overweight vehicles, shall review the current fee structure applied to overload and overweight vehicles operating on the highways of the Commonwealth pursuant to Articles 17 (§ 46.2-1122 et seq.) and 18 (§ 46.2-1139 et seq.) of Chapter 10 of Title 46.2 of the Code of Virginia.
The review shall endeavor to determine what, if any, additional fees should be associated with damage and additional maintenance costs caused by such vehicles and what mechanism is best suited for the collection of such additional fees.
Based on this review, the Commissioner of the Department of Transportation, in consultation with the Department of Motor Vehicles and affected industry representatives, shall recommend legislation regarding the fee structure applied to overload and overweight vehicles operating on the highways of the Commonwealth to the Governor and the members of the Senate Finance and Transportation Committees and the House Appropriations and Transportation Committees no later than December 1, 2008.
2. That the second enactment of Chapter 738 of the Acts of Assembly of 2007 is amended and reenacted as follows:
2. That from July 1, 2007, to July 1, 2008, the annual
overweight permit fee shall be $800 for each eligible vehicle. Such vehicles
shall pay an annual overweight permit fee of $265 from July 1, 2008, to June
30, 2009. The Commonwealth Transportation Board, in consultation with
the Commissioner of the Department of Motor Vehicles, shall
establish a fee structure that shall become effective on July 1, 2008
2009, based on the results of a study of overweight vehicles.
