AMENDMENT IN THE NATURE OF A SUBSTITUTE

  A BILL to amend the Code of Virginia by adding a section numbered 52-28.1, relating to reporting of gang-related criminal information.

Be it enacted by the General Assembly of Virginia:

1.  That the Code of Virginia is amended by adding a section numbered 52-28.1 as follows:

§ 52-28.1. Reporting of gang-related criminal information; inclusion in annual Crime in Virginia report.

When it is determined by a state or local law-enforcement agency that a criminal incident is a gang-related predicate criminal act, as defined by § 18.2-46.1, that information shall be forwarded to the Department of State Police and shall be included in the annual Crime in Virginia report. The reporting agency shall convey the information to the Department of State Police electronically in a form, time and manner prescribed by the Superintendent.
