A BILL to amend and reenact § 28.2-106.1 of the Code of Virginia, relating to the Virginia Marine Police enforcement of federal security and safety zones and to authorize the Virginia Beach Marine Patrol to enforce federal security and safety zones.

Be it enacted by the General Assembly of Virginia:

1.  That § 28.2-106.1 of the Code of Virginia is amended and reenacted as follows:

§ 28.2-106.1. Patrol and enforcement of federal safety zones and restricted areas.

Pursuant to authority provided in 46 U.S.C. § 70119 federal authorization, the Virginia Marine Police may patrol and enforce all federal security zones and, federal safety zones, and federal restricted areas located within the tidal waters of the Commonwealth, including but not limited to those security zones and safety zones designated in 33 C.F.R. Part 165. Pursuant to authority provided in 33 U.S.C. § 1225, the Virginia Marine Police may patrol and enforce all federal restricted areas located within the tidal waters of the Commonwealth.

2.  That the Virginia Beach Police Department Marine Patrol is authorized to patrol and enforce federal zones as follows:

§ 1. That pursuant to federal authorization, the Virginia Beach Police Department Marine Patrol may patrol and enforce all federal security zones, federal safety zones, and federal restricted areas located within the tidal waters of the Commonwealth that fall within the Virginia Beach Police Department's jurisdiction.
