SB 652 Passenger rail transportation liability; limitations.

SUMMARY AS PASSED:

Passenger rail service liability.  Authorizes an authority, comprised of two or more political subdivisions of the Commonwealth that provide public rail transportation services, to contract with a railroad company to allocate financial responsibility for claims related to passenger rail services.  The measure limits the aggregate liability of the authority and the railroad company for claims arising from a single accident or incident related to passenger rail services to $250 million per incident or accident.  Willful and wanton conduct, felonious criminal conduct, and gross negligence are not subject to the cap.  The bill provides for an adjustment to the cap for inflation starting in 2011.  This bill is identical to HB 317.

Passenger rail service liability.  Defines authority as a political subdivision of the Commonwealth that is comprised of two transportation commissions collectively engaged in providing public rail transportation services and allows such an authority to contract with a railroad company to allocate financial responsibility for claims related to passenger rail services. There are provisions limiting aggregate liability.

Passenger rail service liability.  Authorizes any agency or political subdivision of the Commonwealth that provides public rail transportation services to contract with a railroad company to allocate financial responsibility for claims related to passenger rail services. The measure limits the aggregate liability of the agency or political subdivision and the railroad company for claims arising from a single accident or incident related to passenger rail services to $200 million per incident or accident.
