Be it enacted by the General Assembly of Virginia:

1. § 1. Certain certificate of public need applications authorized.

Notwithstanding the provisions of § 32.1-102.3:2, any standards promulgated by the Board of Health in regulations pursuant thereto, or the provisions of any current Request for Applications (RFAs) issued by the Commissioner of Health pursuant to § 32.1-102.3:2, the Commissioner of Health shall accept applications and may approve a certificate of public need authorizing the relocation and replacement of, and addition of, no more than 56 new nursing home beds to any nursing home facility located in Planning District 16 that is composed of no more than 35 nursing home beds, when (i) the facility to be replaced is the only nursing home licensed and operating in the city or county in Planning District 16 and (ii) the replacement facility will be located in the same city or county as the facility to be replaced.
