Be it enacted by the General Assembly of Virginia:

1.  § 1. No Child Left Behind; withdrawal.

A. Effective July 1, 2006, the Commonwealth shall withdraw from participation in the federal No Child Left Behind Act (NCLB).

B. The Board of Education and Office of the Attorney General of Virginia shall bring suit against the United States Department of Education if, as a result of the Commonwealth's withdrawal from the voluntary NCLB, Title I funds that are not directly related to NCLB and that help children from low-income families meet challenging academic content and achievement standards are withheld.
