A BILL to authorize the Governor to sell and convey former Staunton Correctional Center, and to repeal Chapter 705 of the Acts of Assembly of 2004, relating to the sale and conveyance of the former Staunton Correctional Center.

Be it enacted by the General Assembly of Virginia:

1.  § 1. That the Governor is authorized to sell and convey, upon consultation with the Attorney General, and in consideration of the mutual promises of the parties and the payment of $1, and contingent upon a contract being entered into pursuant to §2, the former Staunton Correctional Center (SCC) and the land within the fenced-in area around the SCC (the property) to the Staunton Industrial Authority located in Staunton, Virginia.

§ 2. The sale and conveyance shall not be made until the Staunton Industrial Authority enters into a contract with the Commonwealth in which it (i) agrees to take all reasonable and necessary actions to reconvey the property to an entity so that within five years of the conveyance, the Staunton Industrial Authority will receive from the entity (a) the fair market value of the property, or (b) begin receiving the fair market long-term rental payments for the property; and (ii) agrees to pay all amounts it receives for the reconveyance of the property, less its necessary and reasonable costs, to the Commonwealth. The fair market value for the sale or lease of the property shall be stated in the contract.

§ 3. The sale and conveyance shall be made in a form approved by the Attorney General. The appropriate officials of the Commonwealth are authorized to prepare, execute, and deliver a contract, deed, and other documents as may be necessary to accomplish the sale and conveyance.

§ 4. All proceeds received by the Commonwealth by virtue of this act shall be deposited by the Comptroller into the general fund of the state treasury.

2.  That Chapter 705 of the Acts of Assembly of 2004 is repealed.
