SUMMARY AS PASSED:
Day of rest laws; application to industry and business. Reinstates the business and industry exemptions to Virginia's day of rest laws. The bill corrects the error contained in legislation passed in the 2004 Session of the General Assembly that inadvertently removed these exemptions from the Code. The bill also states that it is the intent of the General Assembly that case law interpreting the meaning of the applicable exceptions in the former § 18.2-341 be considered applicable to this act.

The bill is retroactive to July 1, 2004, the date the erroneous legislation became effective.
This bill responds to the Governor's call for the July 13, 2004, Special Session for the sole purpose of reinstating the exemptions that were "inadvertently removed from law during the 2004 Regular Session." The Richmond Circuit Court in The Smithfield Packing Co., Inc. v. Davenport entered an order temporarily enjoining application of the day of rest laws against employers that had been exempted prior to July 1, 2004.
