SUMMARY AS PASSED HOUSE: (all summaries)
Special education. Directs school divisions to provide special education to children of school age who are Virginia residents and who reside in a facility dually licensed by the Departments of Health as a nursing facility and Mental Health, Mental Retardation and Substance Abuse Services as a residential care facility as of January 1, 2003, by adding these children to the definition of "children with disabilities, residing within its jurisdiction."
In addition, Board of Education regulations will identify these children who are eligible to be placed in public school programs. Finally, the measure provides that the school division may charge tuition as provided in § 22.1-5.
