035312852Be it enacted by the General Assembly of Virginia:
1. That the Code of Virginia is amended by adding a section numbered 10.1-1186.5 as follows:
§ 10.1-1186.5. Electronic equipment recycling program.
A. As used in this section:
1. “Cathode ray tube” means an intact glass tube used to provide the visual display in televisions, computer monitors, oscilloscopes and similar scientific equipment.
2. “Electronic equipment” means devices that contain complex circuitry, circuit boards or signal processing, and that contain hazardous materials that may pose a risk to public health or the environment if discarded as part of mixed solid waste or disposed of in a solid waste management facility. Electronic equipment includes, but is not limited to, cathode ray tubes, computers, televisions and cell phones.
B. The Department shall develop and implement regulations for an electronic equipment recycling program. The program shall:
1. Work with local governments and businesses to determine the most efficient means of collecting, storing, transporting, processing and recycling electronic equipment;
2. Develop public education programs on the benefits of electronic equipment recycling and how to accomplish it; and
3. Promote the recycling or donation of electronic equipment.
C. On or before July 1, 2004, and annually thereafter, the Department shall publish a list of electronic equipment and organizations that accept such electronic equipment for recycling or donation.
D. Beginning July 1, 2004:
1. No person shall knowingly dispose of a cathode ray tube in mixed solid waste;
2. No solid waste management facility shall knowingly accept for disposal any cathode ray tube, or any truckload or container of solid waste that includes a cathode ray tube; and
3. Cathode ray tubes shall be disposed of only as permitted under the electronic equipment recycling program established by the Department.
