Be it enacted by the General Assembly of Virginia:

1. That § 23-91.21 of the Code of Virginia is amended and reenacted as follows:

§ 23-91.21. Property, duties, contracts, etc., vested in rector and visitors of University; principal administrative officer of division; powers of board of visitors generally; title of local administrative officer.

A. All property, property rights, duties, contracts and agreements of such division are vested in the rector and visitors of the University of Virginia. The president of the University of Virginia, by virtue of his office, shall be the principal administrative officer of such division. The board of visitors of the University is charged with the care and preservation of all property belonging to such division. With respect to such division the board of visitors shall have the same powers as to granting degrees, as to fixing tuitions, fees and charges, as to borrowing money and issuing bonds, as to the appointment and removal of administrative officers, professors, agents and servants, and the making of rules and regulations, as are now vested in them with respect to the University. The title of the chief local administrative officer of such division shall be fixed by the board of visitors.

B. Contingent upon the rezoning of such property for such development uses, the division, through the rector and visitors of the University of Virginia, may transfer up to twenty acres of real property gifted to the College at Wise before July 1, 2003, and located in the County of Wise, to the University of Virginia Real Estate Foundation, for the development of residential or commercial activities that primarily focus on student or College-related activities, as agreed to by the division, the rector and board of visitors, and the Foundation.
