Be it enacted by the General Assembly of Virginia:

1. § 1. That there is hereby appropriated, for fiscal year 2001-2002, $4,597,855 from the general fund and $5,845,393 from nongeneral funds for certain water quality activities as follows:

A. There is hereby appropriated, for fiscal year 2001-2002, $2,692,000 from the general fund of the state treasury as designated in the Annual Report of the Comptroller for fiscal year 1999-2000 and $3,545,393 from nongeneral funds to the Water Quality Improvement Fund pursuant to § 10.1-2128 of the Code of Virginia, to be used in accordance with the following provisions of this section:

1. $1,692,000 of such general funds and $500,000 of such nongeneral funds shall be provided to the Department of Conservation and Recreation for nonpoint source pollution control projects pursuant to § 10.1-2132 of the Code of Virginia. A minimum of $2,000,000 of these funds shall be used for the Best Management Practices cost-share grant program.

2. The remaining $1,000,000 of general funds and $3,045,393 of nongeneral funds shall be provided to the Department of Environmental Quality for point source pollution control projects pursuant to § 10.1-2131 of the Code of Virginia.

B. There is hereby appropriated, for fiscal year 2001-2002, $1,700,000 from the general fund of the state treasury and $2,300,000 from nongeneral funds for the Combined Sewer Overflow Matching Fund pursuant to § 62.1-241.12 of the Code of Virginia. From the Combined Sewer Overflow Matching Fund, the City of Richmond shall receive $2,000,000 in fiscal year 2001-2002 and the City of Lynchburg shall receive $2,000,000 in fiscal year 2001-2002 to match federal funds received by each city.

C. There is hereby appropriated, for fiscal year 2001-2002, $205,855 from the general fund of the state treasury for the Marine Resources Commission to match federal funds for oyster remediation activities.

That the Governor’s Executive Order Seventy-four (01) issued on February 24, 2001, shall not affect or alter in any way authorization and appropriation previously made for the Department of Conservation and Recreation, Mason Neck State Park Shoreline Erosion Control and Related Waterfront Improvement project pursuant to Chapter 1073 of the Acts of Assembly of 2000. ]

2. That on or before June 30, 2001, the State Comptroller shall transfer [ $1,905,855 $2,655,855 ] to the general fund from the Small Business Environmental Compliance Assistance Fund.

3. That the appropriations made pursuant to this act are in addition to any and all applicable appropriations made pursuant to Chapter 1073 of the Acts of Assembly of 2000.

4. That no provision of this act [ , other than the provisions of paragraph D., ] shall alter the effect of any and all budget actions that have been taken, or will be taken pursuant to the Governor's Executive Order Seventy-four (01) issued on February 24, 2001.
