SUMMARY AS PASSED:

Privacy of electronically filed court records. Requires the Supreme Court to promulgate rules to restrict remote electronic access to records in any cases filed electronically in the electronic filing pilot projects, to judges, court personnel, any persons assisting such persons in the administration of the electronic filing system, counsel of record, and parties appearing pro se. The bill expires on July 1, 2002.

SUMMARY AS PASSED HOUSE:

Privacy of electronically filed court records. Provides that the Supreme Court shall promulgate rules to restrict remote electronic access to records, in any cases filed electronically in the electronic filing pilot projects, to judges, court personnel, any persons assisting such persons in the administration of the electronic filing system, counsel of record, and parties appearing pro se. The bill expires on July 1, 2002.

SUMMARY AS INTRODUCED:

Sequestration of record; sealing records for electronic access. Requires a case file to be sealed from remote electronic access at a party's request. This does not seal the record in the traditional manner, but only from electronic access. Thereafter, only the court and registered counsel of record in the case are allowed remote electronic access to the file. A party may access his own electronically sealed file by remote electronic means and the public may access an index of filed documents. This bill does not limit access to an electronically sealed court file by anyone who personally appears at the clerk's office provided the file has not been sealed by court order in the traditional manner.
