An Act authorizing the Department of Mental Health, Mental Retardation and Substance Abuse Services to convey certain rights-of-way to Amherst County.

Be it enacted by the General Assembly of Virginia:

1. § 1. That notwithstanding any law to the contrary, the Department of Mental Health, Mental Retardation and Substance Abuse Services is hereby authorized to (i) enter into an annual agreement with Amherst County, upon terms and conditions the Department deems proper and until such time as the property is sold or converted to another use by the Commonwealth, with the approval of the Governor and in a form approved by the Attorney General, which agreement shall provide for the use by Amherst County of a fifty-foot right-of-way on property owned by the Department of Mental Health, Mental Retardation and Substance Abuse Services and referred to as tax map parcel 160-A-69, beginning at the intersection with State Route 334 and the private road leading to the county sewer pump station and following said private road in a southeasterly direction to its point of intersection with property described in Deed Book 486, page 364, and (ii) convey a one hundred-foot right-of-way running along the James River, beginning at the northwest corner of the property owned by the Department of Mental Health, Mental Retardation and Substance Abuse Services and referred to as tax map parcel 160-A-69, and continuing southeasterly to the end of said property.

§ 2. The appropriate officials of the Commonwealth are hereby authorized to prepare, execute and deliver such deed, agreement or other documents as may be necessary to accomplish the requirements of § 1 of this act.
