1999 SESSION
Be it enacted by the General Assembly of Virginia:
1. That the Code of Virginia is amended by adding a section numbered 36-106.1 as follows:
§ 36-106.1. Authority of localities to enact enhanced penalties for repeat building code violations.
Any locality may by ordinance provide for the imposition of an enhanced penalty, in addition to those penalties described in § 36-106, for any person who is convicted of three or more building code violations for separate offenses relating to health and safety during a ten-year period. The enhanced penalty shall be confinement in jail for not more than ten days and a fine of not more than $2,500, either or both. Such ordinance shall provide that an action seeking imposition of the enhanced penalty shall be brought by the local government attorney or other attorney acting on behalf of the locality.
