Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding a section numbered 15.2-906.1 as follows:

§ 15.2-906.1. Authority to enact enhanced penalties for repeat building code violations.

Any locality may by ordinance provide for the imposition of an enhanced penalty, in addition to those penalties described in § 36-106, for any person who is convicted of three or more building code violations during a ten-year period. The enhanced penalty shall be a jail term not to exceed ten days and a fine not to exceed $2,500.
