Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding a section numbered 33.1-206.1 as follows:

§ 33.1-206.1. Commissioner to establish uniform designs and installation criteria for markers; other markers prohibited; penalty.

The Commissioner shall prescribe a uniform design and installation criteria for markers, generally comparable to roadside historical markers, to commemorate law-enforcement personnel and Department employees killed while engaged in their official duties on or along public highways in the Commonwealth. The Department shall bear all costs associated with the production, installation, and maintenance of markers installed under this section.

Erection of any marker, sign, object, material, or other item memorializing any person or persons within the right-of-way of any public highway except as described in this section shall constitute a Class 4 misdemeanor.
